Digital Product License Agreement
Effective Date: Upon Purchase Licensor: Kimberly I. Houston, Baking and Pastry Curriculum (bakingandpastrycurriculum.com)
Licensee: The individual educator completing the purchase
1. AGREEMENT OVERVIEW
By purchasing any level of the Baking and Pastry Curriculum, you agree to the terms of this Digital Product License Agreement. Please read this agreement carefully before completing your purchase. Your purchase constitutes your acceptance of these terms.
2. WHAT YOU ARE PURCHASING
This agreement grants you a single-user, non-transferable, non-exclusive license to access and use the digital curriculum materials associated with your purchased level. Your license includes all units and components included in the purchased level at the time of purchase.
3. PERMITTED USE
You may:
Access and download the curriculum materials for your own classroom instruction
Print materials for use with your own students in your own classroom
Use the materials to plan, deliver, and assess instruction in your teaching environment
Reference the materials for personal professional development
4. RESTRICTIONS
You may not:
Share, distribute, transfer, or resell your login credentials or downloaded materials to any other person
Allow another educator, administrator, or staff member to access your account or use your materials — each educator requires their own individual license
Upload, post, or otherwise distribute any curriculum materials to any shared drive, school server, district platform, or third-party platform
Reproduce or distribute materials for use in multiple classrooms without purchasing the appropriate number of individual licenses
Use the materials to create derivative curriculum products for sale or distribution
Claim authorship or ownership of any materials included in this curriculum
5. DISTRICT AND SCHOOL USE
This license is granted to the individual purchaser only. It does not extend to any school, department, or district. Schools and districts wishing to provide access to multiple educators must purchase an individual license for each educator. Volume licensing is available for districts with 10 or more educators — contact us at [email protected] for district pricing.
6. INTELLECTUAL PROPERTY
All curriculum materials, including but not limited to lesson plans, slideshows, assessments, handouts, review games, and sub plans, are the original intellectual property of Kimberly I. Houston and are protected by United States copyright law. Purchase of a license does not transfer ownership of any materials. All rights not expressly granted in this agreement are reserved by the Licensor.
7. NO REFUND POLICY
Due to the immediate digital nature of this product, all sales are final. No refunds will be issued after purchase. A complete unit — Unit 1: Safety and Sanitation — is available as a free download prior to purchase so that educators may evaluate the curriculum before committing. By completing your purchase you acknowledge that you have had the opportunity to review the curriculum format and quality and are satisfied with your purchase decision.
8. ACCESS AND DELIVERY
Digital access to your purchased curriculum level will be granted immediately upon payment confirmation through the Member Collective portal at https://bec8xunpzw3i4z7abtc6.app.clientclub.net/login It is your responsibility to maintain access to your login credentials. If you experience technical difficulties accessing your materials, contact us at [email protected] within 30 days of purchase.
9. UPDATES AND MODIFICATIONS
Kimberly I. Houston reserves the right to update, modify, or improve curriculum materials at any time. Updates to purchased levels will be made available to existing licensees at no additional cost where applicable. The Licensor also reserves the right to modify these terms at any time — continued use of the materials constitutes acceptance of any updated terms.
10. LIMITATION OF LIABILITY
The Baking and Pastry Curriculum is provided for educational purposes. Kimberly I. Houston makes no guarantees regarding specific student outcomes, program results, or district approval of these materials. To the fullest extent permitted by law, the Licensor shall not be liable for any indirect, incidental, or consequential damages arising from the use of these materials.
11. GOVERNING LAW
This agreement shall be governed by the laws of the State of Georgia. Any disputes arising under this agreement shall be resolved in the appropriate courts of Fayette County, Georgia.
